Seminar on “Challenging the Forced Expulsion of Foreigners and Stateless Persons: Key Features and Effective Representation Strategies”

On October 4, 2024, under the auspices of the Bar Council of Kharkiv Region, a seminar on the topic “Challenging the Forced Expulsion of Foreigners and Stateless Persons: Key Features and Effective Representation Strategies” was held as part of the lawyers’ continuing education program. The event was led by Ivan Goncharov, head of the Migration Law Committee.

The two-hour seminar, conducted online and gathered lawyers from the Bar Council of Kharkiv Region. The participants had the opportunity to delve into relevant issues related to legislative norms and legal strategies concerning cases of forced expulsion of foreigners and stateless persons.

The seminar’s agenda covered the following key topics:

  1. Legislative framework for forced expulsion:

Participants examined both national legislation regulating the forced expulsion of foreigners and stateless persons. Special attention was given to standards that ensure the protection of the rights of foreigners, as well as the legal framework in Ukraine.

  1. Legal grounds for forced expulsion:

Ivan Goncharov provided a detailed explanation of the reasons and conditions that may justify expulsion decisions. The discussion also covered the authorities’ powers responsible for making such decisions and their legal limits.

  1. Procedures for challenging forced expulsion decisions:

A major focus of the seminar was the procedure for appealing forced expulsion decisions. Participants learned about the rights of foreigners and stateless persons during the appeal process and effective strategies that lawyers can use to protect their clients’ interests.

  1. Case law analysis:

The seminar concluded with an analysis of current case law on forced expulsion cases. Special emphasis was placed on the amendments to Article 30 of the Law of Ukraine “On the Legal Status of Foreigners and Stateless Persons,” introduced by Law No. 2952-IX of February 24, 2023, which impacted the regulation of border protection and appeals against expulsion decisions.

This seminar provided lawyers with valuable insights and practical recommendations for effectively defending the rights of foreigners and stateless persons facing forced expulsion from Ukraine.
