Ukraine’s President, Volodymyr Zelenskyi, has signed Law No. 4411, approved by the Verkhovna Rada, “On Amendments to the Code of Ukraine on Administrative Offenses Regarding the Improvement of Legislation in the Field of Migration.” This law aims to strengthen control over irregular migrants and enhance efforts to prevent and combat illegal migration within the country.
The primary objective of this legislative initiative is to enhance the existing norms of the Code of Ukraine on Administrative Offenses, introducing stricter accountability for violations of migration legislation.
President Zelenskyi Boosts Measures against Illegal Migration in Ukraine with New Law
Key provisions of the document include:
Establishing administrative responsibility for non-compliance with legal requirements by State Security Service employees during the execution of their official duties related to the prevention and countering of illegal migration.
Introducing accountability for the host party’s failure to fulfill obligations concerning foreigners and stateless individuals they have invited to or are hosting in Ukraine.
Improving norms pertaining to the powers exercised by officials of the Ministry of Internal Affairs and Communications, and the State Border Guard Service to combat violations of legislation on the legal status of foreigners, along with the implementation of administrative detention.
With the implementation of this new law, Ukraine aims to strengthen its efforts in managing migration and maintaining border security.
New Migration Legislation in Ukraine: Stricter Penalties for Violations
Effective from August 20, 2023, Ukraine’s new migration legislation imposes tougher penalties for non-compliance with legal requirements concerning migration policies, combating illegal migration, citizenship, and registration of migrants. Here are the key provisions:
Article 185-15: Failure to comply with legal requirements of central executive body officials, who are responsible for migration matters, may result in a fine ranging from UAH 850 to UAH 1,700 for citizens and from UAH 1,700 to UAH 2,550 for officials. Repeat offenses within a year may lead to fines ranging from UAH 1,700 to UAH 2,550 for citizens and UAH 850 to UAH 3,400 for officials.

Article 203: Violating the legislation on the legal status of foreigners and stateless persons may result in a fine of UAH 1,700 to UAH 3,400 for exceeding the established stay period by no more than 30 days or non-compliance with transit passage requirements or place of residence registration. Exceeding the stay period by more than 30 days, staying without valid documents, or using expired documents may lead to a fine of UAH 3,400 to UAH 5,100. Repeat offenses within a year may entail fines from UAH 5,100 to UAH 10,200.
Please note that minors and specific circumstances, such as notifying the authorities of document loss or abduction, are exempt from certain provisions.
